Election Compliance Audit Committee

BE IT RESOLVED THAT the Committee issues the following decision and reasons: Upon receiving report ACS2025-OCC-GEN-0010 titled “Auditor’s Report – Election compliance audit of the campaign finances of Candidate Shawn Menard, Ward 17 Capital, from the 2022 Municipal Elections” [the “ Report ”] and upon hearing the representations and/or reading the written submissions and documents submitted by the Auditor, the Candidate, and the Applicant’s representative, this Committee hereby decides not to commence legal proceedings against Candidate Shawn Menard for apparent contravention(s) of the election campaign finance provisions under the Municipal Elections Act, 1996 [“ MEA ”]. Discussion Auditor’s Report The Committee considered the Auditor’s Report, which concluded as follows: There does not appear to be an apparent non-compliance with paragraph 88.22 (1) (d) and subsection 88.25 (3) of the MEA. There is an apparent non-compliance with section 88.19(3) of the MEA. There does not appear to be an apparent non-compliance with paragraphs 88.22 (1) (g) and (h) of the MEA. With respect to the apparent violation, the Report stated that the amount recorded in the financial statement for the election campaign signs reused from the previous municipal election was inaccurate. Specifically, the Auditor found Mr. Menard understated the sign expenses by $310.98.
